These Privacy Notice describes about how we ("IconicC"), together with its affiliated companies – "Affiliate", "You" or "Us") collect, stores, uses and discloses personal data when you use our Services. As used herein, all rights which will be detailed on this Site in accordance with such features - it is just underlying guidelines and User Agreement, emails, alerts and marketing channels, integrations or communications under our control ("our" site collectively with our eCommerce Operating System platform, the "Service").

I. Data Collection & Processing

When we collect your personal data, it consists of data about or information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, to an individual. It does not include aggregated or identified information that is impersonal in a form that is not reasonably capable of being connected with or related to an individual.

  • Individual customers, and identity data consists of and personal contact information, such as name, contact information, account ID, user ID, type identifier, and email identification, or user information provided as part of the setup/registration process (first and last name, Company name, email address) and/or information and appropriate location based upon type of IP addresses (geolocation), device data like app, OS, device ID, browser version, audio, video and all types of devices.
  • Information concerning our customers, users and prospects: process and business details such as name, email, phone number, position, workplace and professional information. We may collect information about our products and services purchased by customers, like Product description, attributes and insights related to our potential or existing engagements, purchasing details information including details and/or purchasing history, customer service interactions, preferences and other details that users provide to us related to our Services.
  • Service integration data: refers to information generated by or from integrations provided by us or from integrations or from interactions or from the use of our Services. This type of personal data described above with respect to users or other individuals whose data is contained in the Customer Data, in accordance with our Data Processing Agreement / Data Processing Agreements.

II. Data Uses & Lawful Bases for Processing

If you use the Services via a territory governed by privacy laws under which "Consent" is the only or most appropriate lawful basis for the processing of personal data, then we will use "Consent" as a legal basis for processing. When processing personal data on behalf of our Customers to provide them with the Services, or due to needs of such processing, our acceptance of our Terms of Service or the execution of another service agreement with IconicC and the Data Processing Agreements that we may enter into when appropriate, forms the contractual and data processing agreement between us and our Customers.

We do not sell your personal data for the intents and purposes of the California Consumer Privacy Act (CCPA) or California Consumer Rights Act (CCRA) and have not sold personal data within the past.


III. Data Storage and Transfer

We store your information including personal data on owned (leased) hardware, tools and process personal data in the United States of America, Europe, Israel and other locations, as reasonably necessary for the proper performance and delivery of our Services. For our internal business purposes or the locations of our process or regions or third parties who work with us for a particular purpose, the data will be maintained on servers, computers or other storage mechanisms. We take technical and administrative measures and such appropriately lawful mechanisms and contractual terms assigning adequate data protection, regardless of any local legal requirements that may apply in those countries to protect your data.


IV. How Long Will We Retain Your Personal Data

The purpose for which we may retain the data is to continue to maintain and expand our relationship and provide you with our Services and offerings. In order to comply with legal and contractual obligations, or to protect our interests from any potential disputes as required by applicable law. To determine the appropriate retention period for personal data, we consider the purpose, nature, and sensitivity of the personal data, the potential risk of harm from unauthorized use or disclosure of your personal data, the purposes for which we process your personal data and the applicable legal requirements.

Please note that except as required by applicable law or in our specific agreements with you, we will not be obligated to retain your personal data for any particular periods. We may retain, purge and/or anonymize Personal Data in accordance with applicable laws as required by applicable law.


V. How We Share or Otherwise Disclose Your Personal Data

Service Providers

We may engage external service companies and individuals to perform services on our behalf or complementary to our own. Such service providers include, but are not limited to: hosting and deployment services, cloud applications (like Zapier, Hubspot, etc.), cloud applications and APIs (such as OpenAI and partners), help and assistance services, web and product analytics, e-mail distribution and monitoring services, labeler or gallery-founding services, remote service companies, and administrative services.

Service Integrations

Using our Services or third-Party Addons requires connecting or integrating with third-party services, for example, HubSpot, Google Ads, Astonics Apps, and more. These third parties or third party services may, in some cases, share some information with us or may store data from Iconicc.

Sales Operations

If you attend an event or webinar organized by us or download or access as work at our sites related to such as sales webinar or other activity organized or sponsored by us, we may share your registration details with our Affiliates or the service hosts, sponsors, or co-organizers of the event.

Public Disclosures

We may disclose your personal data as required by applicable law or regulation when we believe that disclosure is necessary to protect our rights and/or or lawful business. If you wish to remove your public notice, please contact us at support@iconicc.com.

Legal Compliance

We may be legally required to disclose personal data to government or other authorities in connection with law enforcement, dispute resolution, safety, or legal compliance.

Business Acquisitions

We may sell, divest or transfer our business, assets, liabilities or any part thereof, to a company or individual. As part of the acquisition or transfer process, we may share your data with the relevant purchaser or with a business for due diligence and/or in connection with the Transfer.


VI. Cookies and Data Collection Technologies and Do Not Track

We respect you, and we are committed to our disclosure to your personal data and with respect to all requests, you may need to ask you to provide us with certain evidence to make sure that you are who you claim you are. We will not charge a fee to process or respond to your verifiable privacy request unless it is excessive, repetitive, or manifestly unfounded.


X. Data Controller/Processor

When we're a data controller: We and our affiliated companies are the data controllers of our Customers' and our users' personal data in connection with the provision of the Services in the Privacy Notice.

When we're a data processor: In providing the Services to our Customers, we process Customer Data on behalf of our Customers (each a "data controller" of their data, of such data). In such context, we act as "data processors" of your data.

This Privacy Notice describes the categories of personal data we may collect and the sources of such information (as Section 1 above), and our retention (Section III and IV). You have a Right to Know if we collect personal data about you, You have a Right to Delete your personal data, and you have the Right to Correct inaccurate personal data, and you have a Right to Opt-Out of targeted advertising, "sale" or sharing of personal data.
